ATLANTA – It seems that the continuing federal case towards suspended District 113 State Consultant Sharon Henderson (D-Covington) will go to trial quickly.

On Thursday, U.S. Justice of the Peace Choose Regina D. Cannon denied a movement to dismiss the 12-count federal indictment towards Henderson. In the identical submitting, Cannon licensed the case as prepared for trial.

Henderson was arrested on Dec. 8 and charged with two counts of theft of presidency funds and 10 counts of creating false statements. Federal prosecutors declare that Henderson collected $17,811 in false unemployment advantages throughout the COVID-19 pandemic.

Henderson reportedly made claims that she was out of labor as an alternative instructor for Henry County Colleges because of the pandemic. However the U.S. Division of Justice says that Henderson had not labored for Henry County Colleges since 2018, regardless of her submitting certifications to obtain unemployment advantages and accepting stated advantages as not too long ago as 2021.

Gerald Griggs, who’s serving as Henderson’s lawyer, filed a movement to dismiss all counts on Feb. 21. Griggs argued that the fees introduced towards Henderson exceed federal jurisdiction.

“There is no such thing as a allegation that Ms. Henderson interacted with a federal company or official in making these statements,” Griggs wrote. “Accordingly, the indictment raises critical questions of jurisdictional overreach and selective prosecution, warranting dismissal or, alternatively, discovery and an evidentiary listening to.”

Within the occasion the case was not dismissed, Griggs sought to have an evidentiary listening to on the grounds of selective prosecution.

In a response filed one month later, U.S. attorneys claimed that federal jurisdiction was acceptable for these accused of creating false statements on state unemployment profit functions. Additionally they denied any declare of selective prosecution.

“Defendant, a sitting state elected official, identifies no equally located people who obtained completely different remedy, and has equipped no argument for her declare that her fraud on the federally funded emergency applications was merely a ‘state-level’ matter,” the U.S. attorneys wrote.

In the end, Cannon absolutely sided with the U.S. attorneys. A trial date has not been set as of press time.

Two different state representatives, Karen Bennett (D-Stone Mountain) and Dexter Sharper (D-Valdosta), have additionally been arrested and charged with pandemic unemployment fraud-related costs, although their circumstances are unrelated. Each have pleaded responsible and have since resigned from workplace.

Henderson has maintained her innocence all through the proceedings.

“I used to be extraordinarily confused and shocked after I was instructed by FBI brokers that I used to be being arrested,” Henderson wrote in a fundraiser hyperlink titled  “Justice For State Rep Sharon Henderson.” “All I may assume was ‘what may I presumably have finished?’ I used to be baffled. I’ve by no means been accused of any fallacious doing in my total life. I’ve by no means had any authorized points, by no means been accused of any crime, and I’ve by no means been arrested. I’m 67 years previous. I’d by no means do that or do something unlawful!”

Henderson was suspended from her state workplace by Gov. Brian Kemp on Jan. 22 after a assessment fee discovered that the legal allegations “adversely have an effect on the administration of duties.” She is suspended from workplace pending the ultimate disposition of her ongoing legal case or till her time period expires, whichever comes first.

Nonetheless, Henderson has declined to run for a fourth time period in her present District 113 Home seat. As an alternative, she is operating for the District 43 State Senate seat, which represents western Newton County, Rockdale County and elements of DeKalb and Gwinnett Counties.
